Comunicado sobre Audiencia Inicial

El día de ayer, luego de una jornada intensa de lucha desde los tribunales en Intibucá contra la criminalización del COPINH, les comunicamos lo siguiente:
1.- Una vez más quedó claramente demostrado que el propósito de la empresa DESA y el Ministerio Público de Intibucá, servil de la empresa, con sus acusaciones vacías y manipuladoras, son la postura del poder económico que busca criminalizar la causa histórica del COPINH y del Pueblo Lenca. Quedó clara su demostración de racismo y desprecio al Pueblo Lenca, en un alegato lleno de mentiras, contradicciones y hasta ridículo. Quedó también más que evidenciada la agresión, el intervencionismo, y el abuso, de parte de la institucionalidad del Estado contra el Pueblo Lenca en general.
2.- Los testigos y los abogados de la defensa, encabezados por el compañero Víctor Fernández, tuvieron un papel fundamental, haciendo una declaración y defensa conciente, audaz, firme, que demuestra que los indígenas de Río Blanco están en la lucha, por su convicción y por su legitimidad como pueblo originario, defendiendo sus derechos colectivos e individuales, y que no hay ningún fundamento que incrimine a nuestros compañeros de los hechos de los que se les acusa.
3.- El Ministerio Publico y los acusadores privados, al momento de presentar las peticiones al Juzgado Primero de Letras, pidieron auto de prisión con medidas sustitutivas para Aureliano Molina y Tomas Gómez, que consistirían en la prohibición de hacer presencia en el supuesto “lugar de los hechos”, presentarse al juzgado a firmar cada 15 días, y que el abogado defensor sea responsable de la actuación de ambos compañeros; en el caso de Berta Cáceres, Coordinadora General del COPINH, los acusadores pidieron prisión.
4.- La Jueza conocedora del caso, la Abogada Lissien Lisseth Knight Reyes, NO dio la resolución el día de ayer, fijando el acto de dar a conocer la misma para el próximo viernes 20 de septiembre del presente año, a las 03.00PM en el Juzgado Primero de Letras de Intibucá.
5.- La empresa amenaza con presentar más acusaciones contra los tres compañeros encausados, y también contra otros miembros de los Consejos Indígenas, Consejo de Ancianos y Ancianas, y Patronato de la Tejera en Río Blanco.
6. Mientras tanto, se han desplegado más fuerzas policiales y más militarización y acoso contra las comunidades del norte de Intibucá, incluyendo Río Blanco. Todo esto, como producto de la firma del Acta entre el Gobierno, la empresa, con impostores dirigentes patronales e indígenas, con la participación directa de SEDINAFROH y del Presidente Porfirio Lobo Sosa.
7.- Alertamos a las comunidades organizadas al COPINH, al movimiento social, a la Resistencia hondureña, a las fuerzas políticas y sociales progresistas, a quienes les convoca la causa en defensa de los bienes de la naturaleza, a la solidaridad internacional y organismos de derechos humanos, QUE LO QUE SE ESTÁ PRETENDIENDO Y SE PIDIÓ POR PARTE DE LOS ACUSADORES, ES QUE SE ORDENE EL DESALOJO VIOLENTO EN RÍO BLANCO, UTILIZANDO LAS FUERZAS REPRESIVAS DEL ESTADO, AMENAZA CONDENABLE E INACEPTABLE PUES EL PUEBLO LENCA NO PUEDE SER DESALOJADO DE SU PROPIO TERRITORIO, OCUPADO POR MILES DE AÑOS, CRIMINALIZANDO AÚN MÁS SU LUCHA JUSTA Y DIGNA.
8.- Llamamos a la lucha y solidaridad militante, y a que dirijan acciones ante el Estado de Honduras. Ratificamos que el COPINH, pese a todas las circunstancias de ataque y criminalización, continúa y continuará en el desarrollo de su proceso en defensa de los territorios, de la cultura, la espiritualidad, los bienes comunes de la naturaleza, del Pueblo Lenca y por la dignidad.

Communique on the Initial Hearing
Yesterday, after an intense campaign of struggle from the court houses of
Intibuca against the criminalization of COPINH, we communicate the
following:
1.- Once again it was clearly demonstrated that the intent of the DESA
corporation and the Public Ministry of Intibucá, in obedience to this
corporation with its empty and manipulative accusations, is a posture of
economic power that seeks to criminalize the historical cause of COPINH and
the Lenca People. The demonstration of racism and belittlement of the
Lenca People was a false witness of accusations full of lies, contradictions
and even absurdity. What was even more clear was the aggression,
interventionism and abuse on the part of the institutions of the State
against the Lenca People in general.
2.- The witnesses and defense lawyers, headed by the compañero Víctor
Fernández, played a fundamental role, making a declaration of defense that
was conscious, bold, firm and demonstrated that the indigenous people of Río
Blanco are in struggle, with their conviction of their legitimacy as a First
People, defending their collective and individual Rights, and that there is
no basis for the accusations against our compañeros for their deeds.
3.- The Public Ministry and the private accusers, at the moment of
presenting their petitions to the First Court of Letters, asked for a
sentence of prison with substitute measures for Aureliano Molina and Tomas
Gómez, which would consist of a prohibition of being present in the “scene
of the crime”, to present themselves to the Justice every 15 days, and that
the defense lawyer would be responsible for the behavior of both compañeros;
in the case of Berta Cáceres, General Coordinator of COPINH, the accusers
asked for prison.
4.- The female Judge in the case, the lawyer Lissien Lisseth Knight Reyes,
DID NOT make a judgment yesterday, putting the date for a subsequent hearing
to take place next Friday September 20, 2013 at 3:00 p.m. with the First
Court of Letters of Intibucá.
5.- The company threatens to present more accusations against the three
defendants, and also against Other members of the Indigenous Council, the
Council of Elders, and the Neighborhood Council (Patronato) of Tejera in Río
Blanco.
6. In the meanwhile, more police forces have been deployed and more
militarization and harassment in the communities to the north of Intibucá,
including in Rio Blanco. All this is a result of the signature of an Act of
Government, the company, and indigenous and council imposters, with the
participation of SEDINAFROH, and President Porfirio Lobo Sosa.
7.- We alert the communities organized by COPINH, to the social movements,
to the Honduran resistance, to the progressive political and social forces,
to those we call you to the cause of the defense of the goods of nature; to
international solidarity and human rights organizations, that what the
accusers are proposing and pushing for is the violent eviction (of the
blockade) in Rio Blanco, using the repressive forces of the State, an
unacceptable and shameful threat, to evict the Lenca People who cannot be
removed from their own territory, occupied for thousands of years, and
thereby criminalizing their just and noble struggle even more.
8.- We call for struggle and acts of strong solidarity among all those who
undertake actions in the face of the Honduran government. We ratify that
COPINH, despite all the circumstances of attack and criminalization, will
continue the development of this process of defense of the territories, the
culture, the spirituality and the common goods of nature, of the Lenca
People and for dignity.

Comunicato sull'Udienza Iniziale
Ieri, al termine di una intensa giornata
di lotta nel tribunale di Intibucà contro la criminalizzazione del COPINH,
comunichiamo quanto segue:
1. Ancora una volta risulta evidente
che l'impresa DESA e il Pubblico Ministero di Intibucà, servo dell'Impresa, con
le sue accuse vacue e manipolatorie, hanno un atteggiamento che cerca di
criminalizzare la lotta storica del COPINH e del popolo LENCA. E' evidente la
dimostrazione di razzismo e disprezzo del Popolo Lenca con una requisitoria
piena di bugie e contraddizioni ridicole. E' evidente, infine, l'aggressione,
l'interventismo e l'abuso incostituzionale dello Stato contro il Popolo Lenca
in generale.
2. I testimoni e avvocati della
difesa, guidati dal compagno Victor Fernandez, sono stati fondamentali con una
difesa cosciente, audace e ferma che dimostra che la popolazione indigena di
Rio Blanco è in lotta per la sua convinzione e la sua legittimità di popolo
originario, difendendo i sui diritti collettivi e individuali, e che non esiste
nessun elemento che incrimini i nostri compagni dei fatti di cui sono accusati.
3. Il Pubblico Ministero e gli
accusatori privati, nel presentare la denuncia al Tribunale, hanno richiesto la
detenzione con misure sostitutive per Aureliano Molina y Tomas Gomez che
consistono nel divieto di essere presenti nel cosiddetto "luogo dei
fatti", presentarsi al Tribunale per firmare ogni 15 giorni, e che
l'avvocato difensore sia responsabile del comportamento dei due compagni; nel
caso di Bertha Caceres, Coordinatrice Generale del COPINH, gli accusanti hanno
richiesto la detenzione.
4. Il giudice assegnato al caso, la
Avvocata Lissien Lisseth Knight Reyes, non ha emesso la sentenza nel giornata
di ieri, rinviando la stessa al prossimo Venerdì 20 Settembre alle 15.00 nel
Tribunale di Intibucà.
5. L'impresa sta minacciando di
presentare nuove accuse nei confronti dei tre compagni già sotto processo e
contro altri membri dei Consigli Indigeni, del Consiglio degli Anziani e
Anziane, e del Patronato della comunità di Tejera - Rio Blanco.
6. Contemporaneamente, si stanno schierando
altre forze di polizia, più militarizzazione e vessazioni contro le comunità
del nord di Intibucà, tra cui Rio Blanco. Tutto questo, come risultato della
firma dell'accordo tra Governo e Impresa con dirigenti patronali e indigeni
corrotti e con la partecipazione diretta di SEDINAFROH e del Presidente
Porfirio Lobo Sosa.
7. Allertiamo le comunità
organizzate, il COPINH, i movimenti sociali, la Resistenza hondureña, le forze
politiche e sociali progressiste, chi lotta in difesa dell'ambiente, la solidarietà
internazionale e gli organismi in difesa dei diritti umani,
QUELLO CHE PRETENDONO ED HANNO GIA'
CHIESTO GLI ACCUSATORI, E' CHE SI ORDINI LO SGOMBERO VIOLENTO IN RIO BLANCO,
UTILIZZANDO LE FORZE REPRESSIVE DELLO STATO, MINACCIA CONDANNABILE ED INACCETTABILE.
IL POPOLO LENCA NON PUO' ESSERE CACCIATO DAL SUO PROPRIO TERRITORIO, OCCUPATO
DA MIGLIAIA DI ANNI, CRIMINALIZZATO ANCORA UNA VOLTA PER LA SUA GIUSTA E DEGNA
LOTTA.
8. Chiamiamo alla lotta e alla
solidarietà militante, e che si compiano azioni nei confronti dello stato di
Honduras. Ratifichiamo che il COPINH, nonostante tutti gli attacchi e la
criminalizzazione, continua e continuerà nel portare avanti il suo processo in
difesa dei territori, della cultura, la spiritualità, i beni comuni della natura,
del Popolo Lenca e per la dignità.
I fiumi non si vendono, si proteggono e si difendono!
Con la forza ancestrale di Icelaca, Lempira, Mota e Etempica si sollevano
le nostre voci piene di vita, giustizia, libertà dignità e pace!
Basta con la criminalizzazione della lotta del COPINH!
